Expert hiring terms

Purpose and role of Diaglana
These terms govern hiring expert services (diagnosis, programming, coding and remote or in-workshop assistance) in the expert marketplace of the Diaglana platform (app.diaglana.com), operated by Reprorace SL, NIF B75382259, Avda. Montes de Oca, 20, Nave 15, 28703 San Sebastián de los Reyes (Madrid), España. They complement the platform terms of use.
Diaglana acts as an intermediary: it puts the customer in touch with the expert, collects payment on behalf of the expert's workshop and provides messaging, reviews and dispute handling. The service contract is concluded between the customer and the expert's workshop, which provides it under its own responsibility. Diaglana does not provide the technical service and is not a party to that contract.
Who provides the service
Each expert belongs to a workshop shown on their profile and on the quote. The workshop is the provider: it is responsible for the work, for being qualified for the service and for its tax obligations. Workshops contract as traders; before they can be paid we check their identity, address and payout account through Stripe (Article 30 of the Digital Services Act) and show you their name and country.
Experts are shown according to the filters you choose; none pays to appear higher. Only someone who has closed a job with that expert can review them.
How hiring works
You send an enquiry and the expert replies with a quote: fixed price or hourly (with the estimated hours), lead time and validity. Until you accept it there is no contract and no charge.
Before accepting you see the expert's price, the Diaglana service fee and the total. When you accept the quote, with the second factor, the contract with the workshop is concluded and you pay the total by card on Stripe's payment page. If online payment is not available, no quote can be accepted.
Contact details stay hidden until acceptance. The conversation stays on the platform so that issues can be resolved.
Price, service fee and commission
The price is that of the accepted quote, in euros, with the taxes that apply to the workshop.
Customer service fee: 5% of the price, with a minimum of €0.99 and a maximum of €25, taxes included. It is shown before you accept and Diaglana invoices it to you.
Workshop commission: 12% of the price, with a minimum of €2, plus taxes, which Diaglana deducts from the payment and invoices to the workshop. The customer does not pay this commission. The figures may change; those in force when you accept the quote apply and are stored with the job.
Payment and payout to the workshop
We collect the total on behalf of the workshop with Stripe. The money is held until you confirm the work or, if you do not reply, until 7 days after the expert closes it; it is then transferred to the workshop, less the commission. While an issue is open the workshop is not paid.
Paying through the platform counts as paying the workshop: Diaglana collects as its agent and your debt to the workshop is settled.
Cancellation, withdrawal and refunds
Before the work starts, either party can cancel. If you have already paid, we refund the total, service fee included.
If you are a consumer you have 14 calendar days from acceptance to withdraw without giving reasons (Articles 102 to 108 of the Spanish consolidated General Law for the Defence of Consumers and Users). If you ask for the work to start before that period ends, you will pay for the part already provided; once it has been fully provided with your express consent and your acknowledgement that you lose the right, you can no longer withdraw (Article 103.a).
To withdraw, use «Cancel» on the job or write to info@reprorace.com. The model form on the withdrawal page can also be used.
Issues and disputes
You have 72 hours from when the expert delivers the work to confirm it or open a dispute. If you do not reply, it is deemed accepted. While the dispute lasts the payment stays held.
A person at Diaglana reviews the messages, the report and the evidence of both parties and decides: complete, full or partial refund, or no refund. We explain the reasons and you can challenge the decision on the platform, before a certified out-of-court dispute settlement body (Article 21 of the Digital Services Act) or in court. This does not limit your consumer rights against the workshop.
Reports and prohibited services
You can report a profile, a message or a review with «Report». We review reports promptly, decide with reasons (Articles 16 and 17 of the Digital Services Act), you can challenge the decision (Article 20) and we publish the figures in the transparency report.
Illegal services are not allowed, such as tampering with the odometer or disabling emissions or safety systems. We may refuse the job, hold the payment and suspend the expert.
Personal data
We process the job's data (identification, messages, attachments and payments) to manage it and to meet legal obligations, as explained in the privacy policy. On acceptance the workshop receives the data it needs to provide the service and is responsible for its use. Stripe processes payment data as an independent controller. Messages are kept for 2 years after closing.
Changes and governing law
We will tell you about changes to these terms before they apply to new jobs; accepted jobs keep the terms of that moment. Spanish law applies and, if you are a consumer, the mandatory rules of the country where you live, and you may go to the courts of your place of residence.
